Terms of Service
Acceptance
By accessing or using marginsmith.ai (the "Marketing Site") or the MarginSmith application (the "Product"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Marketing Site or Product.
Who Can Use MarginSmith
MarginSmith is designed for licensed trade contractors doing business in the United States. You must be at least 18 years old and authorized to bind the business you represent. Team members added under a team plan must be authorized by the account owner.
Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at security@marginsmith.ai if you suspect unauthorized access.
Subscription and Billing
MarginSmith is offered on subscription plans available monthly or annually. Your subscription renews automatically at the end of each billing period unless you cancel. You can cancel any time from Settings.
On cancellation:
- Your account enters a 30-day grace period during which you can reactivate without losing data
- Published landing pages remain live during the grace period
- After 30 days of continued cancellation, published landing pages go offline and account data is scheduled for deletion
Refunds: annual plans are refundable pro-rata within the first 30 days. Monthly plans are non-refundable but you may cancel any time to stop future charges.
The Free Profit Check
The free Profit Check is available at marginsmith.ai/grade and inside the MarginSmith app. It is free to use, and you can see your result before creating an account. Creating a free account is optional and is only needed to save your result and unlock your exact annual figure.
Your Content
You retain all rights to the business information, credentials, reviews, photos, and other content ("Your Content") that you provide to the Product. By providing Your Content, you grant MarginSmith a limited license to use it solely to deliver the Product features you request (generating your landing page, running audits, producing ad content, etc.).
We never sell Your Content, share it with other users, or use it to train third-party AI models.
Published Landing Pages
When you publish a landing page through the Web Engine, the page becomes publicly accessible at a URL. You are responsible for the accuracy of the content displayed — including credentials, service claims, warranties, and pricing. MarginSmith does not verify the accuracy of business information you provide.
You represent that you have the legal right to display all credentials, licenses, and reviews on your published page and that they are current and accurate.
Acceptable Use
You may not use MarginSmith to:
- Publish false or misleading credentials, license claims, or reviews
- Impersonate another contractor or business
- Generate content that violates any law or third-party rights
- Attempt to reverse-engineer, resell, or otherwise abuse the Product
Violation may result in immediate suspension or termination of your account without refund.
AI-Generated Content
The Product uses large language models to generate landing page copy, ad scripts, mission plans, and other outputs. While we work to ground outputs in the real business facts you provide, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing all AI-generated content before publishing or using it externally.
Service Availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance and unexpected outages may occur. We are not liable for temporary unavailability.
Limitation of Liability
To the maximum extent permitted by law, MarginSmith is not liable for indirect, incidental, or consequential damages arising from your use of the Marketing Site or Product. Our total liability for any claim shall not exceed the amount you paid MarginSmith in the 12 months preceding the claim.
Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law provisions. Any dispute shall be resolved in the state or federal courts located in Delaware.
Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email to the address associated with your account at least 30 days before the change takes effect.
